Subscribers acknowledge that they are voluntarily participating in online yoga and meditation classes offered by Tess Clarkson. Subscribers understand that these activities involve physical movement, stretching, and mindfulness practices, which may carry inherent risks.
Each subscriber represents and warrants that:
I am in good physical and mental health and am capable of participating in these activities.
I am responsible for creating a safe and suitable environment for my practice, including adequate space, proper flooring, and appropriate props.
I understand that due to the virtual nature of the classes, the instructor cannot provide hands-on adjustments, or personalized guidance.
I understand that technical difficulties can occur, and that those difficulties are outside of the control of the instructor.
I understand that I am responsible for listening to my body and stopping any exercise that causes pain.
I understand the risks of physical injury, including but not limited to muscle strains, sprains, fractures, and other musculoskeletal injuries, as well as potential emotional or psychological distress.
In consideration of being permitted to participate in these classes, I hereby:
Assume full responsibility for any and all risks, injuries, or damages, known or unknown, which might occur during or as a result of my participation.
Release, waive, and discharge Tess Clarkson its instructors, employees, and agents from any and all liability, claims, demands, actions, or causes of action whatsoever arising out of or related to any loss, damage, or injury, including death, that may be sustained by me, or to any property belonging to me, whether caused by the negligence of the releasees or otherwise, while participating in these activities.
I agree to indemnify and hold harmless Tess Clarkson, its instructors, employees, and agents from any loss, liability, damage, or costs, including court costs and attorney's fees, that they may incur due to my participation in said activities.
I have carefully read this liability waiver and release, and I fully understand its contents.
I am aware that this is a release of liability and a contract that I am agreeing to of my own free will through my participation.
